As many of you may know, the offices of ASN/Maxam Nutraceutics, TurboSonic USA and Big Gym were raided by the FDA on April 7, 2011. Life at our offices has not yet returned to normal. We are doing everything within our power to stay in business. In order to stay in business, we MUST be compliant with FDA regulations. Due to what the FDA is telling us, (and we do not fully understand all of these regulations), we have been working closely with our attorneys in an effort to become fully compliant with FDA regulations. This means that the labels on many of our products have changed. We’ve even had to change the names of some of our products. We know this has created some confusion, and for this, we apologize.
At this point in time, we are not allowed to make any claims about our products or even make recommendations, per the FDA’s demands on us. In the past, we used to send out suggested protocols for both the ASN/Maxam Nutraceutics and TurboSonic USA product lines. We can no longer do this either because these suggestions were not approved by the FDA. We even had to remove the hundreds of wonderful testimonials that our satisfied clients have sent to us over the years. Know why? Because the FDA says that if there are testimonials on the same web site that you can BUY the product on, then the testimonials become AN EXTENSION OF YOUR LABEL!! Well, of course we didn’t know that. So we moved the testimonials. Hopefully we can bring them back soon.
We were also accused of selling what the FDA calls “new drugs.” Know why? Because on our FORMER labels, it used to say, ‘Shake well. 1-8 sprays under the tongue, one or more times a day on an empty stomach, hold for 1-2 minutes, or as directed by your health care practitioner.’ The problem here was that we failed to tell our clients to SWALLOW the product after they held it in their mouths. You wouldn’t think that this is a big deal, but, according to the FDA, a dietary supplement is meant to be INGESTED. Well, Maxam’s products are meant to be ingested too, but, we didn’t know we had to tell people to swallow the products. We simply assumed that they were. Anyways, we are doing our best to get things straightened out. We have spent an exorbitant amount of money on attorney fees, just trying to be compliant and stay in business. We need your help though!!
Our attorney has advised us to get as many letters as possible from our clients. The FDA has accused Maxam of mail fraud. This means that the FDA believes Maxam has sent out products, through the mail (or UPS) knowing that they don’t work!! Nothing could be further from the truth!! We truly believe in these products and we know that our customers believe in them too, otherwise, we would have been out of business a long, long time ago. Could you help us out? We would greatly appreciate any and all responses from our clients letting the FDA know that you were, in fact, not frauded by ASN/Maxam Nutraceutics, TurboSonic USA or the Big Gym.
